This page explains how Funda responds when an authority (police, public prosecutor, court, administration) asks it for data about a user or content.
1. Funda is not a government service
Funda is a private and independent service. It is neither the police nor a government service, and it gives no authority direct or permanent access to its users' data.
Partner services that use the professional tool Funda Ops to respond to an incident see in it only what is needed for that response. This is not access to user accounts. [À COMPLÉTER : liste des services partenaires et cadre des accords]
2. A legal basis is required
We respond only to a request that is:
- in writing, received through an official channel ([À COMPLÉTER : adresse de réception des demandes des autorités]);
- issued by a competent authority, clearly identified;
- based on a provision of Congolese law that authorizes it to obtain this data;
- specific: which person or which content, which data, for which period, in which proceedings.
A request that is oral, informal, or that does not meet these conditions is refused or sent back to be completed.
3. We disclose the minimum
- We check that the request is well founded and proportionate.
- We disclose only the data that is strictly requested and necessary.
- A request that is too broad is challenged or narrowed.
- Much of the data simply no longer exists on our side: SOS locations are deleted at the end of the session, device locations after 30 days, the photo of a missing person when the case is closed. We cannot disclose what we do not keep.
- Medical information and the identity document in the profile are encrypted before being saved.
4. We inform the person when possible
We inform the user concerned of the request before disclosing, unless:
- the law forbids it;
- a decision of the authority forbids it for the duration of the proceedings;
- warning them would put a person in danger, for example a child.
When the prohibition ends, we inform the person if we can.
5. Life-threatening emergencies
If an authority informs us of an immediate danger to a person's life or physical safety, we may disclose without delay the data strictly necessary to avert it. The request must then be formalized in writing.
6. What does not fall under these requests
- Transmission of a missing person notice at your request. When you submit a missing person notice, Funda may pass the record on to the authorities and send you back the reference. Your identity as the person reporting is passed on only with your explicit agreement, time-stamped and kept.
- Child protection. Child sexual abuse or exploitation content is reported to the authorities on our own initiative: see the "Child protection" page.
7. Traceability
Each request received, the answer given and the data disclosed are recorded. [À COMPLÉTER : publication éventuelle d'un rapport de transparence et sa fréquence]
8. Contact for authorities
